Gurunath Meiyappan and Raj Kundra involved in betting, Srinivasan not guilty of cover-up: Supreme Court

The Supreme Court said that N Srinivasan's son-in-law Gurunath Meiyappan and Raj Kundra were involved in betting.

However, it also said that Srinivasan was not guilty of cover-up and "charges against him, at best, be regarded as suspicion." It also said that "BCCI functions are public functions, amenable to judicial law."

"At best there is only a case of suspicion of cover-up against Srinivasan. He had deep-rooted interest in CSK matches; his behaviour raises suspicion but isn't proof," the apex court said.

As a consequence, Srinivasan may now be allowed to contest the BCCI presidential elections that are expected to be held shortly.

The apex court has said that conflict of interest issues remain and Srinivasan has to choose between his IPL team Chennai Super Kings and the cricket Board. The court has also struck down the controversial 6.2.4 clause that allows BCCI officials to own IPL teams.

Black buck hunting case: SC sets aside stay on Salman Khan's conviction

Pronouncing the verdict, Justice Mukhopadhyay said the filmstar could tell the court that he would suffer irreversible damage if his conviction is not stayed and he is eventually acquitted.

The court said that the Rajasthan government at the same time could argue that no irreversible damage which cannot be undone would be caused if his conviction is not stayed.

The Rajasthan High Court had put on hold Salman's conviction on his plea that it was coming in his way to get visa to travel to England. Salman's sentence has already been put on hold by the high court that also suspended his conviction on November 12, 2013.

Salman Khan, Sonali Bendre, Tabu, Neelam and others were accused of hunting the protected blackbuck in Rajasthan during the  shooting for the film 'Hum Saath Saath Hain'.

Salman was convicted by a trial court April 10, 2006, under the Wild Life (Protection) Act and was awarded five years' jail and a fine of Rs 25,000.

Apex court rejects Italian marines' pleas to visit home

"The trial has not commenced. Even the charge sheet has not been filed. It does not happen anywhere in the world. We are sorry," a three-judge bench headed by Chief Justice H L Dattu said.
  
Senior advocates Soli Sorabjee and KTS Tulsi, appearing for the marines, said that even the Central government lawyer has no objection to extension of stay of Latorre on health grounds.
  
"The Solicitor General may not object but we want the system to work," the bench also comprising justices M B Lokur and A K Sikri, said adding, "Let him come. Let the charge sheet be filed. You know that the charge sheet cannot be filed in the absence of accused. We aren't going to allow the application."
  
Sorabjee said that Lattore had heart surgery scheduled on January 8, 2015 in Italy and he may be permitted to stay further for a period of two more months. Later, the counsel for Italian marines withdrew the applications.

Students be not put to difficulty due to Sanskrit in KVs: SC

Observing that "no student should be put to difficulty" due to introduction of Sanskrit in the mid session, a bench of justices A R Dave and Kurian Joseph asked Attorney General Mukul Rohatgi to take instructions on the issue and brief it on December 16.
  
The court direction came after advocate Reena Singh, appearing for a group of parents of Kendriya Vidyalaya students, submitted that a student has to complete three-year language course before he is allowed to appear for the board exams.
  
She said that due to change in language in mid-session, the students will not be able to complete the three-year course in Sanskrit and they will be barred for appearing in the Board exam.
  
"Chaos will prevail when students of class VIII, who have been studying German language for almost two-and-half years, will now have to study Sanskrit as third language. How are they going to complete the course of 3 years? That means they cannot appear in the 10th class CBSE board exam without fulfilling the condition of the CBSE curriculum 2014," she said.

I have done no good work, says Ranjit Sinha

"I am not going to say anything. I have done no good work. Write what you want to write. Enough dirt has been thrown upon me," he shot back at reporters who had asked him to sum up his tenure in CBI.

Sinha faced severe criticism of Supreme Court over probe in Coal and 2G scam.

When asked whether he was also planning to write a book on his experience on the lines of former CAG Vinod Rai, former Coal Secretary PC Parakh, Sinha said, "I will do whatever I have to do. I will not follow them."

Sinha's tenure at the top of CBI has seen highs like busting of some big bribery cases involving a Railway Board member, Chairman and Managing Director of a public sector Bank, Chief Executive Officer of Censor Board among others.

The lows involved criticism he faced from Supreme Court which asked him to step down from 2G probe, criticism from Special Court for shoddy probe in coal scam cases, sharing of status report in coal with the then Law Minister Ashwani Kumar after which agency received sobriquet of "caged parrot" from the apex court.

Women can't be secured by curbing their freedom, says CJI

"Safety of the women could not be achieved by curbing their freedom" and we have to find ways of dealing with the problem, he said in his address at a function organised by the Supreme Court Bar Association on National Law Day.

In a reference to government acquiring more powers in the fight against terrorism with lesser accountability, the Chief Justice said, "We see similar trends in the discourse on protection of women against sexual violence. When I say 'similar trends', I mean that we seem to have a rather worrying affinity to ensure the physical safety of women by curbing their freedom."

"As far as I am concerned, I would like to emphatically state in no uncertain terms, that the security of women achieved by curbing their freedom and liberty is no security at all. We have to find systemic responses to the problem of sexual violence and not resort to measures that have an adverse impact on the agency of women," he said.

In his inaugural address, he touched on several issues including the urgent need for reforming the criminal justice system, erosion of the constitutional protection by the government in its response to the external and internal extremism, and realising the essential needs of the vulnerable sections of the society in the wake of globalisation of economy and trade.

I-T department to prosecute about 300 foreign bank account holders

Officials said the department has informed the Special Investigation Team (SIT), constituted to go into the issue, to allow it to start the "first step of prosecution" under two sections of the Income Tax Act.
   
Prosecution is being sought under Section 277 (false statement in verification) and 276 D (failure to produce documents) so that the department can share information with other enforcement agencies like the ED and CBI, they said.
  
The sources said the department has already realised Rs. 200 in taxes and penalties from some of these account holders who have accepted to holding these accounts abroad.  There could be another Rs.200 crore to Rs.300 crore in taxes and penalties that could be realised from the others, they said.
  
"The list of 627 Indians submitted to the apex court today has close to 300 people against whom prosecution action can be launched soon. Basic prosecution, at least under select sections of the I-T Act. While some 120 cases are already under prosecution these fresh individuals and entities can also be booked based on prima facie evidence gathered by tax sleuths," sources said.
  
They said this will enable the SIT to hand over some vital information to agencies like Enforcement Directorate and CBI who could take action under their mandates and the laws that they enforce.
  
International and bilateral treaties allow a member nation to share such information obtained by one agency with others only at the stage of prosecution or when the matter is in the purview of courts of the land.
  
"The SIT has agreed to this and we expect to file new prosecutions sooner than later. In these 300 cases the I-T department has some evidence," they said.
    
Officials said these cases pertain to the years 1999-2000 and they will get "time barred" by March 2015 and hence there is "no time to loose" for the authorities.
    
Sources privy to the contents of these lists said there are a number of "established" cases where the foreign account is genuine and has been reflected in tax statements filed by the individual or entity.

Black money case: CPI urges SC to give out all names of account holders

The National Executive of CPI, which began a two-day session here, adopted a resolution in this regard, according to CPI General Secretary S Sudhakar Reddy.

"The National Executive of the Communist party of India, currently in session at Hyderabad, with Kanam Rajendran in chair welcomes the stand of Supreme Court on black money and urges upon the apex court to persist with orders for total disclosure of all names of persons who have stashed away black money in foreign banks," the resolution said.

Claiming that the BJP-led government talked about right of privacy of individuals and companies in disclosing the names, the party said it is nothing but an attempt to shield them.

"Earlier, the BJP Government was repeating the arguments of its predecessor – UPA II Government that they can not disclose the names of black money holders as it will breach international agreements.

After Supreme Court punctured this argument it is now crying of rights of privacy of individuals and companies. This is nothing but a crude attempt to shield the culprits. It is believed that the quantum of black money in India is worth USD 3 trillion that is equal to our GDP," the resolution said.

The NDA government has submitted just one list of 627 people given by France, but the government is in possession of other lists received from other countries and foreign banks, it alleged.

"There are other lists in the possession of the government received from other countries and foreign banks.

The National Executive hopes that the Supreme Court will get all these information and not confine it to the Special Investigation Team (SIT). They must be made public," it said.

Asserting that people of India have every right to know the names, the CPI said investigation should be conducted to know how black money was stashed away abroad and for what purposes.

"Apart from holders of foreign accounts, their benefactors including the political parties and other entities should be hauled up. The black money should be confiscated and used for the alleviation of poverty in the country," the resolution said.

The Centre today placed a list of names of 627 Indian account holders in HSBC bank, Geneva in black money case before the SC and directed SIT to open the list and take appropriate action in accordance with law.

Supreme Court Stays Proceedings Against Mallika Sherawat

नई दिल्ली। सुप्रीम कोर्ट ने बॉलीवुड अभिनेत्री मल्लिका शेरावत के खिलाफ अश्लील डांस परफॉरमेंस देने को लेकर बड़ोदरा अदालत के सम्मन पर फिलहाल रोक लगा दी है। जस्टिस बी एच चौहान की अध्यक्षता वाली खंडपीठ ने गुजरात हाईकोर्ट के आदेश के खिलाफ शेरावत की याचिका पर सुनवाई के दौरान ये आदेश दिया।
साल 2007 में वड़ोदरा बार एसोसिएशन के पूर्व अध्यक्ष नरेंद्र तिवारी और मुंबई के जे डब्ल्यू मैरिअट होटल के मालिक ने संयुक्त रूप से मल्लिका के अश्लील डांस परफॉरमेंस के खिलाफ आपराधिक शिकायत दर्ज कर धारा 294 के तहत एक सम्मन जारी किया था। इस बीच, वड़ोदरा की अदालत ने 8 जुलाई को मल्लिका शेरावत के नाम जमानती वॉरंट जारी करते हुए उसे 19 अगस्त को पेश होने का निर्देश दिया था।

तिवारी ने बताया कि उन्होंने पुलिस को मामले की जांच के आदेश दिए थे, लेकिन पुलिस ने कहा कि उनके पास ऐसा कोई मामला ही दर्ज नहीं हुआ है। इसलिए वे जांच नहीं करेंगे। इसके बाद तिवारी ने सेशन कोर्ट में अपील की। इस बीच, मल्लिका भी गुजरात हाई कोर्ट पहुंची लेकिन कोर्ट ने मल्लिका की याचिका खारिज कर दी और वड़ोदरा कोर्ट को इस केस सौंप दिया। इसके बिनाह पर ही अभिनेत्री को सम्मन भेजा गया है।

गौरतलब है कि तिवारी ने मुंबई के एक पांच सितारा होटल में 31 दिसंबर, 2006 की रात शेरावत के डांस के बाद यह शिकायत दायर की थी। शिकायत में कहा गया था कि मल्लिका शेरावत का डांस अश्लील ही नहीं बल्कि उत्तेजक भी था। शिकायत में दावा किया गया था कि जब एक दर्शक ने मंच पर चढ़कर इस डांस को रोकने की कोशिश की तो आयोजकों ने कथित रूप से उसका मजाक उड़ाया।

Lalu Yadav Gets Shock From SC on Fodder Scam

नई दिल्ली। चारा घोटाला मामले में आरोपी राजद प्रमुख लालू प्रसाद यादव को सुप्रीम कोर्ट से झटका लगा है। मंगलवार को कोर्ट ने उनकी जज बदलने की अर्जी को सिरे से खारिज कर दिया है। सुप्रीम कोर्ट ने मामले की दलील पूरी करने के लिए 15 दिन का समय दिया है। कोर्ट ने लालू यादव की याचिका खारिज करते हुए कहा कि ट्रायल कोर्ट यह जज नवंबर 2011 से केस की सुनवाई कर रहे हैं। उन्हें उम्मीद है कि किसी तरह का भेदभाव नहीं करेगा।

इससे पहले लालू यादव ने इस मामले में जज बदलने की अर्जी दायर की थी लेकिन कोर्ट ने सभी पक्षों की बहस सुनकर उस वक्त अपना फैसला सुरक्षित रख लिया था। इस अर्जी में कहा गया था कि जो जज इस मामले की सुनवाई कर रहे हैं वह बिहार के मंत्री के काफी करीबी हैं इसलिए लालू को संदेह है कि इस मामले की निष्पक्ष जांच नहीं होगी। इस दलील के तहत उन्होंने ये अर्जी दायर की थी। लालू प्रसाद ने चारा घोटाले की सुनवाई कर रहे झारखंड के विशेष सीबीआइ जज पर पक्षपाती होने का आरोप लगाते हुए मामले का ट्रायल किसी और जज के पास स्थानांतरित करने की मांग की थी।

गौरतलब है कि झारखंड की अदालत में चल रहे इस मामले में लालू प्रसाद सहित 45 लोग अभियुक्त हैं। आरोप है कि लालू प्रसाद और अन्य अभियुक्तों की मिलीभगत से चाईबासा ट्रेजरी से करीब 35 करोड़ रुपये निकाल लिए गये थे। हाई कोर्ट ने लालू की जज बदलने की मांग खारिज कर दी थी जिसके बाद वे सुप्रीम कोर्ट आए हैं।

Hearing on Durga Shakti's Suspension Plea in SC

नई दिल्ली। उत्तर प्रदेश सरकार द्वारा आइएएस दुर्गा शक्ति नागपाल के निलंबन को चुनौती देने वाली याचिका पर बृहस्पतिवार को सुप्रीम कोर्ट में सुनवाई हो सकती है। याचिकाकर्ता की ओर से शीर्ष अदालत से इस मामले में जल्द सुनवाई का अनुरोध किया जाएगा।

वकील एमएल शर्मा ने याचिका दाखिल कर सुप्रीम कोर्ट के पूर्व आदेशों का हवाला देते हुए दुर्गा के निलंबन को गलत ठहराया है और कोर्ट से दुर्गा का निलंबन एवं अन्य कार्यवाही निरस्त करने की मांग की है।

शर्मा ने बुधवार को भी मुख्य न्यायाधीश पी. सतशिवम की पीठ से याचिका पर शीघ्र सुनवाई का अनुरोध किया, लेकिन पीठ ने तत्काल सुनवाई से यह कहते हुए इन्कार कर दिया कि याचिका अभी सूचीबद्ध नहीं हुई है और वैसे भी दोपहर में मेंशनिंग नहीं सुनी जाएगी। याचिकाकर्ता चाहे तो कल सुबह मेंशनिंग (कोर्ट के समक्ष किसी याचिका पर शीघ्र सुनवाई की मांग करना) कर सकता है।
